When does time-and-a-half kick in?
Under the federal Fair Labor Standards Act (FLSA), non-exempt employees earn time-and-a-half for any hours worked over 40 in a single workweek. Your workweek is a fixed 168-hour period set by your employer — it doesn't have to start Monday.
State rules that override federal
- California: 1.5× for >8 hours/day OR >40/week. 2× for >12 hours/day OR >8 hours on the 7th consecutive workday.
- Colorado, Nevada: 1.5× for >12 hours/day (Colorado) or >40/week.
- Alaska: 1.5× for >8 hours/day OR >40/week.
- Most other states: Follow federal FLSA (over 40/week only).
Who is exempt from overtime?
